Terms of Service
These terms govern your access to and use of Nanny Pact, including building contracts, sending them to families, and collecting e-signatures.
Last updated: June 30, 2026
1. Agreement to Terms
By accessing or using Nanny Pact (the "Service"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Service. Our Privacy Policy describes how we collect, use, and share personal information and is incorporated into these Terms by reference.
2. Not Legal Advice
Nanny Pact provides a tool for drafting and signing work agreements. It is not a law firm, does not provide legal advice, and does not create an attorney-client relationship. Employment and labor rules for household employees vary by state, province, and country, and Nanny Pact does not guarantee that any contract generated through the Service complies with the laws that apply to you or the family you're contracting with.
You are responsible for reviewing each contract before sending it, and for confirming it meets your legal obligations — consulting a qualified professional where appropriate.
3. Description of Service
Nanny Pact provides software for:
- Building work agreements with configurable terms (rate, hours, payday, protective clauses).
- Sending a contract to a family by email for their review.
- Collecting e-signatures from both the nanny and the family, typed or drawn.
- Tracking the status of each contract — draft, sent, or signed.
4. Accounts
Nanny Pact accounts are for nannies and other independent caregivers. You must:
- Be at least 18 years old.
- Sign in using a Google account or a one-time email link sent to an address you control — Nanny Pact does not use passwords.
- Keep your email account and any device signed into Nanny Pact secure, since that's what controls access to your account.
- Provide accurate information about yourself and the families you contract with.
- Be responsible for activity that happens under your account.
5. Your Content and Data
You retain ownership of the contract terms, family information, and other content you enter into Nanny Pact. You grant Nanny Pact a limited license to host, process, store, transmit, and display that content only as needed to provide the Service — for example, emailing a contract to the family you specify, and recording signatures.
You are responsible for making sure your use of Nanny Pact, including any information you enter about a family, complies with applicable law and any agreement or understanding you have with that family.
6. Sending Contracts and E-Signatures
When you send a contract, the family receives a link that lets them view and sign it without creating an account. You are responsible for:
- Entering an accurate email address for the family, and only sending a contract to someone you intend to contract with.
- The accuracy of the terms in any contract you send.
- Confirming, where it matters to you, that an electronic signature collected through Nanny Pact is valid and enforceable in your jurisdiction for this type of agreement.
Anyone with a valid signing link can view and sign that specific contract. Treat signing links the same way you'd treat a document you're about to sign — don't forward them to anyone other than the intended signer.
7. Acceptable Use
You may not use Nanny Pact to:
- Violate any law, regulation, or third-party right.
- Send a contract to someone without their knowledge or consent, or impersonate someone else when signing.
- Enter false information about contract terms or about a family in order to mislead a signer.
- Interfere with, overload, probe, or attempt to disrupt Nanny Pact or its infrastructure.
- Reverse engineer, scrape, resell, or misuse the Service except as allowed by law.
We may suspend or terminate accounts we believe are involved in abuse, fraud, or activity that creates legal or security risk.
8. Plans and Pricing
Nanny Pact offers a free plan and may offer paid plans with additional features. If and when paid plans are available, pricing and billing terms will be presented at checkout and, where applicable, processed by a third-party payment provider. We may change pricing or plan features with reasonable notice.
9. Intellectual Property
Nanny Pact retains ownership of:
- The Service, its design, underlying code, and documentation.
- Nanny Pact's name, logo, and related branding.
- Contract templates, clause language, and other non-user-specific content we provide.
These Terms do not transfer any Nanny Pact ownership rights to you.
10. Service Availability
We aim to provide a reliable service but do not guarantee uninterrupted availability. We may suspend or limit the Service for maintenance, security, abuse prevention, infrastructure issues, or legal reasons.
11. Termination
You may stop using Nanny Pact at any time. We may suspend or terminate accounts that violate these Terms, create legal or security risk, or misuse the Service. Contracts already sent and signed remain valid agreements between you and the relevant family regardless of later account status.
12. Disclaimer
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, NANNY PACT DISCLAIMS WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND LEGAL ADEQUACY OF ANY CONTRACT GENERATED THROUGH THE SERVICE.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NANNY PACT WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR DISPUTES ARISING BETWEEN YOU AND A FAMILY YOU CONTRACT WITH.
NANNY PACT'S TOTAL LIABILITY WILL NOT EXCEED THE GREATER OF THE FEES YOU PAID TO NANNY PACT IN THE 12 MONTHS BEFORE THE CLAIM, OR $100 USD.
14. Indemnification
You agree to indemnify and hold Nanny Pact harmless from claims, damages, and expenses arising from your use of the Service, the contracts you create and send, your relationship with a family you contract with, or your violation of these Terms or applicable law.
15. Governing Law
These Terms are governed by the laws of the jurisdiction in which Nanny Pact operates, without regard to conflict-of-law principles, except where applicable law provides otherwise.
16. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated through the Service, by email, or by updating the effective date above. Continued use of Nanny Pact after changes take effect means you accept the updated Terms.
